Latest Laws Affecting Your Business

Last year's session of congress brought us HICPA. This year Senator Robert M. "Tommy" Tomlinson (R-6th District), the head of the Senate Consumer Protection & Professional Licensure Committee, and the original author of the contractor registration law has already proposed an amendment to HICPA that increases the Attorney General's budget and authority to enforce it. PA Senate Bill 973 creates a fund called the "Home Improvement Account" for all fees and penalties collected under the act. "The funds in the Home Improvement Account and any interest earned shall be dedicated to the Attorney General for administering and enforcing the provisions of this act." Separately the amendment also creates an exemption for home improvement retailers (companies "who sell materials used in home improvement contracts"). Under this amendment, retailers who pay at least $100,000 per store into the "Home Improvement Account" are not required to register or comply with HICPA. Despite the nearly unanimous statewide protest to HICPA by the contracting community, Tomlinson's amendment contains absolutely no provisions to help working contractors cope with the drastic changes under the new law. The bill was drafted on June 18, 2009. It has already been unanimously approved by Tomlinson's Committee and the Senate Appropriations Committee, and is now cleared for debate in the House and Senate.

This year the Pennsylvania Uniform Construction Code was amended to include the EPA's final ruling governing the regulation of remodeling projects involving lead paint. Beginning April 22, 2010 home improvement firms must have a certified contractor on hand to perform work involving the modification of painted surfaces on homes, schools and childcare facilities built before 1978 and inhabited by children under age six. Beyond certification, the new code establishes standards and requirements for the preparation of work sites, lead-safe work practices, waste disposal, clean up and recordkeeping for qualifying projects. Enforcement of the UCC varies across municipalities, so code requirements may differ based on where you're working. Nonetheless, the EPA's ruling governing lead-based paint is federal law, and will be enforced at the state and federal level.

On May 26, 2009 House member Tim Solobay (D-Washington County) drafted the latest incarnation of PA House Bill 1521 (PA State Board of Interior Designers Act) for consideration by the House Professional Licensure Committee. If approved, the bill will hit the floor early this fall, calling for the creation of a state-wide regulatory committee, licensing, restrictions and criminal penalties for interior designers. On May 5, 2009 the PA House of Representatives passed PA House Bill 400 (PA Construction Workplace Fraud Act) with an overwhelming majority. This is the latest legislation attempting to regulate the business of home improvement contracting in Pennsylvania. It will soon control your hiring practices regarding employees and sub-contractors with severe penalties for non-compliance. It's not too late to stop this bill from passing the Senate and getting signed into law!
