Mr. Catarino is currently in Harrisburg pursuing an amendment to the Home Improvement Consumer Protection Act to make it easier on working contractors. His proposed changes have been well received by several Senators and Congressmen with the power to change this law. This amendment protects your contracts from 'voidable clauses' that would make them unenforceable under the new law. Section 7 of the new law outlines the requirements for home improvement contracts after the law takes effect. Section 7(e) lists 11 prohibited clauses that void the entire contract if included. Under Caterino's proposed amendment only the clauses themselves would be voidable if included in a home improvement contract. Including an errant clause would not have the effect of voiding the whole contract. Only the particular banned clause would be unenforceable, which leaves less of a loophole for customers to get out of honoring their contractual obligations.
